Acceptable Use Policy
This Acceptable Use Policy (“AUP”) governs the permitted and prohibited uses of the Q (also known as QBot) platform and related products and services (“Products”) provided by Antares Solutions Pty Ltd. (“Antres Solutions”, “Antares”, “we”, “us”, “our”). This AUP applies to all customers, resellers, partners, and any end users who access or use the Products, whether directly or via a third party.
By accessing or using the Products, you agree to comply with this AUP. Antares may update this AUP from time to time in accordance with the notice provisions in your agreement with us.
1. Permitted Use
You may use the Products solely for lawful business purposes, in accordance with:
- this AUP;
- your agreement with Antares (or with an authorised reseller); and
- all applicable laws and regulations.
2. Prohibited Uses
You must not, and must ensure that your users do not, use the Products to:
2.1 Unlawful, Harmful, or Deceptive Activity
- Engage in any unlawful, fraudulent, deceptive, defamatory, or harmful activity.
- Generate, disseminate, or facilitate child sexual abuse material, terrorism content, or content that incites violence, hatred, or discrimination against any person or group.
- Generate or disseminate content that infringes the intellectual property, privacy, or other rights of any third party.
- Engage in harassment, bullying, or threatening behaviour towards any individual.
2.2 AI/ML-Specific Restrictions
- Develop, train, or improve competing AI or machine learning products or services.
- Reverse-engineer the Products’ underlying models, weights, algorithms, or architecture.
- Use the Products to make automated decisions that have legal or similarly significant effects on individuals (such as decisions about employment, credit, insurance, housing, education, criminal justice, or access to essential services) without appropriate human oversight, transparency, and compliance with applicable law.
- Generate deepfakes, synthetic media, or other content intended to deceive or impersonate a real person without their consent and appropriate labelling.
- Misrepresent AI-generated content as being created by a human without appropriate disclosure where required by law.
2.3 High-Risk Applications
- Deploy the Products in high-risk applications (including critical infrastructure, medical diagnosis or treatment, autonomous vehicles, or weapons systems) unless Antares has expressly consented in writing and you have implemented appropriate safety, oversight, and compliance measures.
- Use the Products in any way that could foreseeably cause death, personal injury, or significant property damage.
2.4 Sensitive Data
- Input or process any special category personal data, sensitive personal information, or health data (as defined under applicable Data Protection Laws) unless you have a lawful basis, have implemented appropriate safeguards, and the use case has been agreed in writing with Antares.
- Input or process payment card data, financial account credentials, government-issued identification numbers, or similar high-risk personal data without appropriate written agreement with Antares.
- Input or process the personal data of children under the age of 16 (or the equivalent age threshold under applicable law) without lawful basis and appropriate parental or guardian consent.
2.5 Security and Integrity
- Attempt to probe, scan, or test the vulnerability of the Products or any related system or network.
- Circumvent or attempt to circumvent any security or authentication measures.
- Interfere with, disrupt, or attempt to disrupt the integrity or performance of the Products or any third-party data contained therein.
- Introduce or transmit any virus, malware, ransomware, or other malicious code.
- Attempt to gain unauthorised access to any portion of the Products, other Customer accounts, or any related systems.
2.6 Legal Compliance
- Use the Products in breach of any applicable law, regulation, or government order, including but not limited to:
- sanctions and export control laws;
- data protection and privacy laws;
- anti-bribery and anti-corruption laws; and
- modern slavery and human trafficking laws.
2.7 Misuse of the Service
- Resell, sublicense, lease, or commercially redistribute the Products except as expressly authorised by your agreement with Antares.
- Use the Products to send unsolicited bulk communications (spam) or engage in any phishing, pretexting, or similar deceptive practices.
- Use the Products to compete with Antares, including by extracting or scraping outputs to develop competing services.
3. Customer and End User Responsibility
You are responsible for all activity conducted through your account and by your users, employees, contractors, agents, and any other persons to whom you provide access to the Products (“Authorised Users”).
You must ensure all Authorised Users comply with this AUP.
You must maintain the confidentiality of all access credentials and notify Antares immediately of any actual or suspected unauthorised use of your account.
Any breach of this AUP by an Authorised User is deemed to be a breach by you.
4. Reporting Violations
If you become aware of any actual or suspected breach of this AUP, you must promptly notify Antares at info@antaressolutions.com.au (or such other contact address as Antares may notify from time to time).
5. Enforcement and Consequences
Antares may, with or without prior notice depending on the severity of the breach:
- suspend or terminate your (or any Authorised User’s) access to the Products;
- remove or disable access to any content that violates this AUP;
- report any activity that Antares reasonably believes violates law or regulation to law enforcement or other appropriate authorities; and
- pursue any other rights or remedies available to Antares under your agreement with us or under applicable law.
Antares is not liable for any loss or damage arising from any action taken under this section.
6. Updates to this AUP
Antares may update this AUP from time to time:
- without prior notice where required to address an unlawful, harmful, or security-related issue; and
- on not less than thirty (30) days’ written notice (which may be given by email, in-product notification, or by updating this AUP at the URL referenced above) for any other update.
Any update will apply prospectively only. Continued use of the Products after the effective date of an update constitutes acceptance of the updated AUP.
